I paid the full $60,000 cash for an off-plan cluster home 18 months ago, but now the developer is demanding a $15,000 'inflation top-up' before handing over the keys. Is this legal, and can they cancel my contract if I refuse to pay?
I bought a unit in a new complex in Pomona off-plan. My agreement of sale had a fixed price. Now that the build is done, the developer claims that the rising cost of cement and the 2025/2026 currency fluctuations mean I have to pay extra, citing a hidden 'force majeure' or 'cost escalation' clause. If I take them to the High Court, will I get my house, or will they just refund my original $60k in useless local currency?
